Michelle Lujan Grisham<\/a> vowed to take her outrage \u201cright to the White House and Congress\u201d to seek assurances the DEA is no longer using the risky law enforcement strategy in New Mexico \u2014 and that it is not being replicated elsewhere. Overdoses have surged in New Mexico, even as fentanyl deaths declined in other states.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">\u201cThis is a stunning failure by the federal government,\u201d the governor told reporters at a news conference in the state medical examiner&#8217;s office in Albuquerque, joining a host of state and local law enforcers and officials demanding answers. \u201cIt\u2019s disgusting and despicable.\u201d<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">The DEA did not immediately respond to a request for comment. <\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">White House spokesperson Abigail Jackson noted that President Donald Trump has classified fentanyl a \u201cweapon of mass destruction\u201d and signed into law legislation <a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/article\/fentanyl-opioid-trafficking-drug-cartels-accc52b76dbdfc569928423de174fb5f\">cracking down<\/a> on the synthetic opioid. <\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">\u201cSadly, the United States is still recovering from Biden\u2019s border crisis and the damage it caused,\u201d Jackson wrote in an email to The Associated Press. \u201cPresident Trump has totally secured the border and has taken bold actions to combat the scourge of fentanyl in American society.\u201d<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Lujan Grisham&#8217;s remarks came a week after <a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/article\/dea-fentanyl-unseized-drugs-new-mexico-8f5b546e668e5007c64078da74b90903\">AP reported<\/a> that DEA agents repeatedly monitored \u2014 but did not seize \u2014 shipments of fentanyl as part of an effort to build bigger criminal cases between 2023 and 2025. <\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Current and former DEA agents, including whistleblower David Howell, told AP the strategy amounted to a gamble with public safety and may have violated U.S. Justice Department rules intended to safeguard the public.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">The DEA initially denied Howell\u2019s allegations in a statement to AP. But the agency later called upon the Justice Department\u2019s independent watchdog <a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/article\/dea-investigations-unseized-fentanyl-inspector-general-88200e171fdf4d5fa103a791aa42952e\">to conduct its own investigation<\/a>.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">The fentanyl went unseized amid the deadliest drug epidemic in U.S. history and as the DEA led a public awareness campaign \u2014 \u201cOne Pill Can Kill\u201d \u2014 emphasizing that even a few milligrams of the substance can be lethal. <\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">New Mexico has responded swiftly to the revelations. Last week, the state&#8217;s attorney general announced a <a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/article\/dea-fentanyl-new-mexico-a29f03d713674d8ff3f5041f470f6277\">criminal investigation<\/a> to determine whether any federal officials broke state law by knowingly exposing New Mexico residents to the synthetic opioid. <\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">\u201cWe\u2019re going to protect the rest of the United States from this kind of foul, \u2018I need a big case&#8217; effort no matter what the consequences,\u201d Lujan Grisham said. \u201cWe\u2019re angry because it\u2019s immoral.\u201d<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Albuquerque Mayor Tim Keller said fentanyl represents his city&#8217;s \u201cNo. 1 challenge,\u201d driving crime and homelessness and straining health care resources.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">\u201cUsing us in some sort of uninformed, undisciplined experiment that\u2019s literally killing our people \u2014 that\u2019s what this is,\u201d he said. \u201cThis should outrage every single New Mexican.\u201d<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Trump last week shared a link on his Truth Social page to an article attributing the scandal to the \u201cBiden-run Justice Department.\u201d In a statement to AP last week, the Justice Department similarly said \u201cthe alleged conduct occurred under the Biden Administration\u2019s disastrous open border policies.\u201d<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Howell first came forward during the Biden administration in 2023 \u2014 and was sidelined for doing so \u2014 but he continued to flag unseized fentanyl shipments as recently as last year, and the largest he documented happened two months into Trump&#8217;s second term, a 1.8-million pill haul DEA learned about but did not intercept in March 2025.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Howell also revealed that the Justice Department in 2024 changed internal guidelines that had urged agents to seize fentanyl whenever \u201cpracticable,\u201d affording them more discretion to preserve longer-term investigations. Empower Oversight, the whistleblower advocacy group representing Howell, called on the Justice Department Monday to reinstate those earlier protocols so authorities \u201ctry to seize fentanyl whenever there is probable cause.\u201d<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Lujan Grisham has criticized both administrations as not doing enough to stem the tide of fentanyl in New Mexico, and pointed to the death last year of a 15-month-old girl who reportedly swallowed some of her mother&#8217;s drugs in Espa\u00f1ola, a town ravaged by grinding poverty and addiction.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">It is not clear whether any fatal overdoses in the state can be directly attributed to the DEA strategy.
