In a 2-1 decision, it found that the law was not unconstitutional and sent it back to a lower court to have <a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/article\/social-media-kids-ohio-netchoice-c7563fc44b8de88f2db9790992fc2cd5\">a block on the law&#8217;s enforcement<\/a> vacated.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">\u201cAt bottom, the Act imposes a parental consent requirement,\u201d Judge Eric Clay wrote in the lead opinion. \u201cThat requirement constitutes a marginal burden that precisely targets the multi-faceted problem that Ohio has identified: Children\u2019s unsupervised assent to terms and conditions for use of platforms that take advantage of and harm them.\u201d<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Judge Alice Batchelder concurred, writing that \u201ca statute is not vague just because it has a wide berth.\u201d <\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Known as the Social Media Parental Notification Act, the Ohio law was part of an <a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/article\/ohio-state-budget-taxes-education-vouchers-6f3c3abf4db444124d6c7b19090f5cc8\">$86.1 billion state budget bill<\/a> that Republican Ohio Gov. Mike DeWine signed into law in July 2023. <\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">The administration pushed the measure as a way to protect children\u2019s mental health, with then-Lt. Gov.
