{"id":1455,"date":"2026-08-08T06:29:14","date_gmt":"2026-08-08T06:29:14","guid":{"rendered":"https:\/\/1newslive.com\/?p=1455"},"modified":"2026-08-08T06:29:14","modified_gmt":"2026-08-08T06:29:14","slug":"what-to-know-about-trumps-new-attempt-to-limit-birthright-citizenship","status":"publish","type":"post","link":"https:\/\/1newslive.com\/?p=1455","title":{"rendered":"What to know about Trump&#8217;s new attempt to limit birthright citizenship"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div data-testid=\"prism-article-body\">\n<p class=\"EkqkG IGXmU nlgHS yuUao MvWXB TjIXL aGjvy ebVHC \">The Trump administration is once again trying to limit who can become an American, with <a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/article\/trump-border-immigration-birthright-citizenship-494add8239eb1c0c9f4ccb45db03f1f0\">a pair of executive orders<\/a> issued this week that attempt to place restrictions on birthright citizenship and on foreigners who give birth in the U.S. <\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">A <a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/article\/supreme-court-birthright-citizenship-trump-immigration-c73cf0c70bb550ebf0a55fafddbd935c\">Supreme Court decision<\/a> in June struck down a previous attempt at restricting birthright citizenship, but Thursday\u2019s orders were made with \u201cadjustments\u201d keeping the decision in mind, President Donald Trump said. <\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Still, some of the restrictions announced by the White House are expected to face legal challenges.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">The 14th Amendment, which makes a citizen of anyone born in the country, and two subsequent Supreme Court decisions interpreting it provide guidelines that already exclude certain births from receiving the citizenship benefit. <\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Trump&#8217;s new attempt to restrict birthright citizenship even after the Supreme Court loss highlights the administration&#8217;s drive to limit who can become an American. <\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Birthright citizenship is guaranteed under current law for anyone who is born on U.S. soil, with a few exceptions.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">The executive order released Thursday was narrower in scope than the previous one shot down by the Supreme Court and appeared to focus on restricting automatic citizenship to specific categories of people, including children born to adults with connections to foreign embassies or organizations as well as anyone considered an \u201calien enemy\u201d of the United States.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">U.S. immigration law says babies born to a \u201cforeign diplomatic officer accredited to the United States\u201d are not entitled to birthright citizenship under the Constitution, including ambassadors, ministers, charg\u00e9s d\u2019affaires, counselors, secretaries and attach\u00e9s of embassies and legations, and members of the Delegation of the Commission of the European Communities.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Trump\u2019s orders Thursday would sharply expand those exemptions.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">One order disqualifies babies who are products of \u201cbirth tourism.\u201d The other applies to children of anyone working in a foreign embassy or representing a foreign government and employees of the United Nations or other international organizations. Children of parents tied to groups that are deemed terrorist organizations, like Antifa or Tren de Aragua, are also excluded.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">\u201cHow is the federal government going to decide that a child is born to a member of a designated terrorist organization?\u201d said C\u00e9sar Cuauht\u00e9moc Garc\u00eda Hern\u00e1ndez, a law professor at Ohio State University. \u201cThese are not organizations that are sharing the membership lists if they even have them.\u201d<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Citizenship through surrogacy has become a concern for Republican members of Congress, some of whom proposed a bill this year that would restrict citizenship for children of noncitizen parents born to surrogates in the U.S. <\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Garc\u00eda Hern\u00e1ndez said he believes the new executive order addressing surrogacy could raise new legal questions. \u201cNeither the 14th Amendment nor any of the Supreme Court\u2019s decisions about how to interpret the 14th Amendment mentions or hints at surrogates,\u201d the law professor said.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Trump\u2019s executive order defines birth tourism as someone who enters the United States on a \u201cnonimmigrant visa for the purpose of giving birth on American soil.\u201d <\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Birth tourism is already considered fraud and grounds to restrict a visa if someone seeks one specifically to come to the U.S. and obtain citizenship for a child. <\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Advocates said the executive order would give immigration officers discretion to deny entry to pregnant women suspected of wanting to give birth in the U.S. without providing clearly defined guidelines.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">The president did not offer data indicating the scope of the problem, but said Thursday: \u201cI\u2019ll tell you right now, hundreds of thousands, OK? Hundreds of thousands.&#8221; <\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Although there&#8217;s no official estimate of how many births can be considered \u201cbirth tourism\u201d cases, experts say Trump\u2019s approximation is exaggerated. <\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">\u201cThe hundreds of thousands just seems like an overestimate based on the sort of limited data that we have available,\u201d said Colleen Putzel-Kavanaugh, an associate policy analyst at the Migration Policy Institute. <\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Data from the Centers for Disease Control and Prevention shows that in 2024 nearly 9,600 children were born to foreign mothers with an official address outside the country. Another estimate from the Center for Immigration Studies, a think tank that advocates for lower immigration, estimated that 20,000 to 26,000 birth tourists come to the U.S. each year.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">The order provides a sweeping indictment of \u201cbirth tourism operators\u201d with no evidence of how widespread they are or how or why anyone accused of using their services would be exempt from constitutional protection.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Those efforts are not new either. Previous administrations have also sought to <a class=\"zZygg UbGlr iFzkS qdXbA WCDhQ DbOXS tqUtK GpWVU iJYzE \" data-testid=\"prism-linkbase\" href=\"https:\/\/apnews.com\/article\/chinese-pregnant-women-birthright-citizenship-260225bd3eea107762b7d2384b096615\">prosecute so-called \u201cbirth tourism\u201d<\/a> schemes that helped women hide their pregnancies while traveling to the United States to give birth. <\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">\u201cBirth tourism operators use deceptive advertisements and inducements to entice foreign nationals to travel to the United States for the purpose of giving birth on American soil,\u201d the order says. <\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">\u201cThey promise citizenship; access to public benefits; and short-term stays in specialized facilities, hotels, or rentals, but often fail to deliver on these promises. These operators coach their clients to misrepresent the purpose and duration of their travel to consular and border officials to obtain visas authorizing entry into the United States.\u201d <\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">The Republican Party has embraced the mission. In late July, the office of the attorney general in Texas announced a \u201csweeping investigation\u201d into potentially unlawful birth tourism schemes after some south Texas hospitals advertised birthing services in Mexico. <\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">Asked Thursday how his orders would survive Supreme Court scrutiny when his last attempt failed, Trump deferred to White House staff secretary Will Scharf, who, like his boss, sounded alarms about \u201cbirth tourism.\u201d He emphasized consular discretion to grant visas.<\/p>\n<p class=\"EkqkG IGXmU nlgHS yuUao lqtkC TjIXL aGjvy \">\u201cWhat we\u2019re doing is taking legally validated means that are clearly within our disposal and targeting them to this birth tourism industry.
